The Council of The Village of Grand Rapids convened in regular session from 7:30 P.M. to 9:40 P.M. in the Grand Rapids Town Hall. Mayor Judy Keifer called the meeting to order with the following members and visitors present:

MINUTES
Hall made a motion, seconded by Erdody to approve the Minutes of the January 11, 2010 meeting with the correction of Sara's name being misspelled.
    Votes were: Berry - aye; Erdody - aye; Hall - aye: Hutchison - aye; Lewis - aye: Williams - aye. MINUTES APPROVED

BILLS: 
Hutchison made a motion, seconded by Williams to pay the bills from January 12 through January 25, 2010.
    Votes were: Erdody - aye; Hall - aye: Hutchison - aye; Lewis - aye: Williams - aye; Berry - aye. BILLS APPROVED

MAYOR'S REPORT: 
Mayor Keifer reminded Council that Hoffman works for the Mayor, Council and the Village. When the Administrator gives his report, if there are problems, clarifications, or things to go to committee before he acts upon it, it should be done during the meeting presented. This allows Chad to know what Council wants him to do.

She received a phone call regarding the Yellow Box report that Jerry Anderson did on Channel 11 and the fact that we have one located in the Village. Hoffman will look into the one located on the elevator property.

ADMINISTRATOR'S REPORT
The Administrator gave his report - a copy is attached.

Hutchison made a motion, seconded by Erdody to continue with the Ohio Plan for 2010 in accordance with the information Hoffman provided.
    Votes were: Lewis - aye; Williams - aye; Berry - aye; Hutchison - aye; Hall - aye; and Erdody - aye. SO MOVED

Hoffman advised Council that the preliminary Village flood maps are at the office if anyone wants to look at them. He will be attending a meeting with FEMA and ODOT tomorrow to discuss the Village flood maps.

HB Bill 117 provides the issuance of state video service authorizations which does away with franchise agreements. We can still collect the 3% franchise fee as a Video Service Provider Fee (VSP fee) if we pass an ordinance within 10 days. We can send them a letter of intent notifying them that we will be passing an ordinance they will continue to honor the current franchise agreement until we can get the ordinance passed. We have the option to collect a fee on the advertising revenue as well if we so desire.

Hutchison made a motion, seconded by Erdody, to have Hoffman draft a letter to TimeWarner with the intent that we will continue to collect the VSB fee with the advertising revenue included.

Hoffman reminded Council that once the franchise agreement is terminated, the Town Hall, Fire Hall, school, library and Admin building may start getting invoices for the cable service we are currently getting for free under the franchise agreement.

Hoffman also brought to the attention that there has been vandalism at the Lincoln Street restrooms. A report has been filed. Tony caught the kids in there and gave their names to the Sheriff. We were advised that if we caught them again, to hold them and contact the Sheriff.

Erdody requested Hoffman bill the Historical Society for their half of the 3 refurbished trash cans we have already had done. Council requests the Historical Society to clarify their position on paying half for refurbished vs. newly purchased cans.

FISCAL OFFICER'S REPORT: 
Rader stated that per the Auditor, Council needed to approve the Supplemental Appropriations in the future. A motion is not needed, just verbal approval listed in the minutes.

SHERIFF'S REPORT: 
The Mayor reported that there are still calls for the "Middle School" showing up on the report.

COMMUNICATIONS: 
The Mayor read a letter from the Toledo Area Bicyclists requesting the use of Wright Pavilion for their annual bike ride. After discussion, Council wants the same stipulations imposed in 2009 to pertain to 2010's ride.

Mayor Keifer passed around a copy letters she received and brought to the attention of Council a letter that she received from the Wood County Commissioners' that was sent to Mayor Mike Bell congratulating him on becoming the Mayor of Toledo and hoping to work with him.

Mayor Keifer advised Council that she received the 2009 Financial Statement from the Grand Rapids Swimming Pool as required by the lease. Hoffman will look over it to see if there are any discrepancies that need to be addressed.

COMMITTEES: 
Berry gave his report on the January Ambulance Board meeting. He will provide a copy for Village reference. Mayor Keifer questioned whether they lowered the amount of taxes for the ambulance. Berry was unable to confirm for sure.

UNFINISHED BUSINESS: 
Lewis questioned the procedure for filling the seat of the Town Hall Board of control.

NEW BUSINESS: 
Erdody expressed a desire to see about having a Mayor's Association meeting in the Village. The Mayor will get contact information for Erdody so she can look into it further and get back to Council. 

EXECUTIVE SESSION: Hutchison made a motion, seconded by Lewis, motion to go into executive session with the Mayor, Administrator, and Fiscal Officer present to discuss possible litigation.
    Votes were: Berry - aye; Hutchison - aye; Hall - aye; Erdody - aye; Lewis - aye and Williams - aye. MOVED TO EXECUTIVE SESSION 

RETURN TO MEETING: 
Hutchison made a motion, seconded by Berry, to return to the regular meeting with no action required.
    Votes were: Hutchison - aye; Hall - aye; Erdody - aye; Lewis - aye; Williams - aye; and Berry. RETURNED TO REGULAR MEETING 

ADJOURNMENT: 
Williams made a motion, seconded by Berry, to adjourn.
    Vote: Hall - aye: Hutchison - aye; Lewis - aye: Williams - aye; Berry - aye; Erdody - aye.

The meeting was adjourned. The next scheduled meeting is February 8, 2010 at 7:30 P.M. at the Grand Rapids Town Hall.
